Governor Rick Perry:

Does anyone in Texas have any control over the Attorney General, Greg Abbott? His office purports to protect consumers, but his actions have hurt thousands of people in his agenda to shut BioPerformance, Inc. down.

He shut the company down like some third-world mafia outfit, without any urgent necessity, and in the process froze it's checking accounts and shut down shipping. Thousands of innocent people have paid for product that couldn't be shipped because of Abbott, and in addition, thousands received checks from the company that bounced because of his actions freezing the assets of the company.

His initial allegations included the company being an illegal pyramid scheme, but he dropped the charges before the hearing on the TRO he issued. He also claimed the company was selling a product that "can't work" based solely on the opinion of a college professor (even though it does) and is toxic (even though it isn't).

At any rate, even if his allegations were valid, which I believe will be proven not to be valid, his over-zealous actions have hurt thousands of innocent people who need some relief. Abbott needs to "unfreeze" the checking accounts, which have sufficient funds to refund any money due to the consumers and also to restore checks which bounced because of his actions.

In his quest to destroy the company, he has also alleged that the owners intend to transfer all the money to overseas accounts or something, when a simple tally (without even looking at the books) shows where all the money went and is. He is totally offbase in this part of his agenda, as a simple accounting of the funds would easily prove.

Someone needs to look into the actions of the Attorney General and try to determine who is driving him and what his agenda is, and give some relief to the thousands of people he has harmed by his actions.

Mr. Abbott,

I'm confused because the only people you are hurting are the consumers that you purport to help. Thousands of people paid for products that you prevented from shipping. Thousands of people received commission checks that bounced because you froze all of BioPerformance's accounts. None of the thousands of people have any product or the money they paid or the commission checks they lost, and the only reason is your over-zealous actions against BioPerformance.

Turn the consumers' money loose. That makes absolutely no sense. The cash is all sitting there in accounts ready to pay back the people, but you are preventing them from getting their money. Some of the people who have emailed me are actually hurting because of your actions. They didn't have extra money to be taken from them by your office.

None of your claims seem very valid, but you closed the company down like it was some third-world mafia outfit. You accused it of being an illegal pyramid scheme, but then dropped the charges. You accused them of of selling a product that can't work, because some college professor says it can't work. None of those allegations will prove accurate, but your office has hurt thousands of the people you purport to protect, simply because of whatever agenda you are operating under.

I'm sure no one is reading this, so I'll stop.

It's August 19 as I'm reviewing the BioPerformance update pages, and I have not received a reply from either of these letters sent TWO MONTHS ago.
