Subject: Bioperformance Update 

Hello Everyone, 

We appreciate everyone's interest in BioPerformance updates.  I will give them as often as I have new information.  Fortunately, I have some good new information. Sometimes it takes a while to get information since Lowell and Gus are honoring the Temporary Restraining Order stipulations of no communication to the field. 

1.    BioPerformance has new legal counsel.  As mentioned in my previous email, the ability to finance their defense was a huge lift for the company. They have chosen a man from Texas that actually sought them out....because he thought they have a strong case.  He worked 25 years in the Attorney General's office (AG) and wrote many of the Consumer Protection laws for the State of Texas.  He feels that he can sit down with the AG's office and work this stuff out prior to trial.  GREAT NEWS, but as always, NO GUARANTEES. 

2.    BioPerformance has concluded testing on 1 or 2 vehicles at the EPA lab in Houston and the results were excellent and they will continue to test somewhere between 20-50 cars. 

3.    The word I heard from some credible sources was that BioPerformance had very positive results that AREN'T CERTIFIED (at this time) but the tests came back "In the state the product is delivered in" the product was 97% Naphlanate (non toxic) and 2% Naphtalene.  They verified that the enzymes do organically change the chemistry of the product.....just like we always said "Non-toxic." safe to handle etc. 

The people I have spoken with to get this information have been a little discouraged over the past 2 weeks but this news has them excited and they believe that BIOPERFORMANCE will be back by the FALL.  They believe these are the components we need to WIN this case. 

Tim Hunter and Brent Robinson are flying to Dallas tomorrow (Monday) and will be returning on Wednesday.  They have some other business to attend to but are hoping to have a chance to get some more updates on BioPerformance. Everyone please continue to have the faith because it's looking VERY GOOD for BIOPERFORMANCE.
